Giveaway Terms and Conditions

These terms apply to prize draws and giveaways operated by Roger Edwards, the operator of Contains Moderate Peril (“the Promoter”).

The individual blog post announcing each giveaway will specify the prize, opening date, closing date and any additional requirements applying to that particular giveaway. These general terms should be read together with the relevant giveaway post.

1. Eligibility

  1. Giveaways are open to residents of the United Kingdom aged 18 or over, unless the relevant giveaway post states otherwise.

  2. Employees, contractors and immediate family members of the Promoter, and anyone professionally connected with the administration of the giveaway, may not enter.

  3. The Promoter may ask a selected winner to provide reasonable evidence of their age, identity or eligibility before awarding a prize.

2. How to enter

  1. Entry is free. No purchase is necessary.

  2. To enter, participants must leave a comment beneath the relevant giveaway blog post during the stated entry period.

  3. Participants must provide a valid email address in the website’s comment form so that the Promoter can contact them if they win. Entrants should not include their email address within the publicly visible text of their comment.

  4. Unless the giveaway post states otherwise, only one entry per person is permitted. Multiple comments, entries made using different email addresses, automated entries and entries submitted on another person’s behalf may be disqualified.

  5. Entries must be received between the opening date and closing date shown in the giveaway post. The website’s recorded submission time will be used to determine whether an entry was received in time.

  6. Comments that are unlawful, abusive, threatening, discriminatory, fraudulent, irrelevant or reasonably considered to be spam may be removed and will not constitute valid entries.

3. The prize

  1. The number and nature of the prize or prizes will be described in the relevant giveaway post.

  2. Unless otherwise stated, prizes are non-transferable, non-refundable and no cash alternative will be offered.

  3. If circumstances beyond the Promoter’s reasonable control make the advertised prize unavailable, the Promoter may substitute a prize of equal or greater value.

  4. Digital game codes, download codes and similar prizes may be subject to geographical, platform, account, hardware, software or age-rating restrictions. Any such material restrictions known to the Promoter will be stated in the giveaway post.

  5. Entrants are responsible for checking that they have the appropriate equipment, account, platform and regional access needed to use a digital prize.

  6. Third-party services, platforms and products remain subject to the relevant provider’s own terms and conditions.

4. Selecting the winner

  1. Each valid entry will be entered into the prize draw.

  2. The winner will be selected at random, normally within seven days after the closing date, using a verifiable random computer process or another random process conducted under independent supervision.

  3. The Promoter will retain an appropriate record of the selection process.

  4. The Promoter may disqualify an entry where it reasonably believes that the entrant has broken these terms, attempted to manipulate the draw or supplied false information.

5. Contacting the winner

  1. The winner will be contacted using the email address supplied with their comment, normally within seven days of the draw.

  2. The Promoter will make reasonable efforts to contact the winner. Entrants are responsible for supplying an accurate email address and for checking their inbox and spam or junk folders.

  3. The winner must respond within 14 days of the first notification email, unless a different period was clearly stated in the giveaway post.

  4. If the winner does not respond after reasonable attempts to contact them, is found to be ineligible, declines the prize or fails to provide information reasonably required to deliver the prize, the Promoter may withdraw the prize and select another winner at random.

6. Delivery

  1. Digital prizes will normally be delivered to the winner’s supplied email address.

  2. For books, Blu-rays and other physical prizes, the winner will be asked privately for a UK postal address. Postal addresses should not be placed in a public comment.

  3. Prizes will normally be sent within 30 days after the winner has responded and supplied any necessary delivery information.

  4. The Promoter is not responsible for delivery problems caused by inaccurate information supplied by the winner.

  5. If a digital code appears to be invalid when first used, the winner should contact the Promoter promptly. The Promoter will investigate the problem and, where reasonably possible, arrange an appropriate replacement.

7. Winner information

  1. The Promoter will publish or make available information showing that a valid award has taken place. This may include the winner’s surname, county or publicly displayed website name.

  2. Entrants may object to the publication of their information, or ask for the amount of information published to be reduced, by contacting [contact email address].

  3. Where an entrant objects, the Promoter may still be required to provide relevant winner information privately to the Advertising Standards Authority or another competent regulator if requested.

  4. The winner will not be required to participate in additional publicity unless they separately agree to do so.

8. Personal information

  1. The Promoter will use entrants’ names, email addresses, comments and any other information supplied in connection with the giveaway for the purposes of: administering the giveaway; validating entries; selecting and contacting the winner; delivering the prize; dealing with enquiries or complaints; and demonstrating that the giveaway was administered fairly.

  2. A winner’s postal address may be shared with a postal service, courier, prize supplier or fulfilment provider where this is necessary to deliver a physical prize.

  3. Entry into a giveaway does not constitute consent to receive newsletters or marketing emails. Entrants will not be added to a marketing list unless they provide separate and optional consent.

  4. Giveaway information will be retained only for as long as reasonably necessary to administer the giveaway, demonstrate that the prize was awarded and resolve any complaint or dispute.

  5. Publicly visible comments may remain beneath the relevant blog post as part of the website’s archive. Email addresses submitted through the comment form will not be displayed publicly or used for unrelated purposes.

9. Technical problems

The Promoter is not responsible for entries that are lost, delayed or not successfully submitted because of a technical failure outside its reasonable control. This does not affect any legal responsibility that cannot lawfully be excluded.

10. Changes or cancellation

The Promoter will not change a closing date, cancel a giveaway or materially alter its terms unless unavoidable circumstances beyond its reasonable control make this necessary.

Where a change is necessary, the Promoter will act fairly, avoid disadvantaging existing entrants wherever reasonably possible and publish an appropriate notice on the relevant giveaway page.

11. Responsibility

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot legally be excluded.

Subject to this, the Promoter will not be responsible for losses that were not reasonably foreseeable or that arise from circumstances outside its reasonable control.

12. Third-party involvement

Unless expressly stated otherwise, giveaways are not sponsored, endorsed, administered by or associated with the manufacturer, publisher, retailer, digital platform or social-media service connected with the prize.

14. Governing law

These terms and each giveaway are governed by the laws of England and Wales / Scotland / Northern Ireland.

Entrants may bring legal proceedings in the courts applicable to the part of the United Kingdom in which they live.
